In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties hereinafter “the Law,” BELO ISLA MUJERES, S.A. DE C.V., hereinafter “HOTEL BELO ISLA MUJERES”, with address Carretera Sac Bajo No. 046 Lt. 5 Mz. 072, SM 07, 77400, Isla Mujeres, Q.R, is responsible for the processing of your Personal Data and Sensitive Personal Data in accordance with this Privacy Notice and acknowledges that the protection of your personal data is a fundamental right. Therefore, we are committed to safeguarding them under the highest legal, technological, and administrative security standards, committing at all times not to sell, share, or disclose them to third parties for illicit purposes or contrary to applicable regulations and the purpose for which you have provided them to us.

Consequently, we ask you to carefully read this Privacy Notice, in which we inform you about the terms and conditions of the use of your personal data, noting that it was prepared based on the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, the Regulations of the Federal Law on Protection of Personal Data Held by Private Parties, as well as the Guidelines on Privacy Notice, legal instruments to which we will refer hereinafter, in a generic manner, as “the Law”.

1. I. PERSONAL INFORMATION PROCESSED.

For the provision of hospitality and hotel services that “HOTEL BELO ISLA MUJERES” will provide to you, in terms of the operating license and the corresponding contract for the provision of hospitality and hotel services, the following personal data are necessary:

1. a) Identification Data: gender, name, nationality, address, telephone number, and email address, if applicable, date of birth, age, marital status, names of ascendants and descendants by blood, economic dependents, and spouse’s name, common-law partner, official identification.
2. b) Financial and Tax Data:bank account or check number, credit or debit card, other types of payment and guarantee instruments that you will use to cover our services and hotel services that are necessary to assist you; information regarding memberships contracted by you or of which you are a member or beneficiary and that are necessary for the provision of the aforementioned services; RFC and tax domicile.

In the processing of such information, “HOTEL BELO ISLA MUJERES” undertakes and commits to observe and comply with the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility in accordance with the Law.

1. II. PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA.

The Personal Identification and Fiscal Data, including financial or patrimonial data that you, personally or as a representative, as the case may be, provide to “HOTEL BELO ISLA MUJERES”, will have the use described below:

1. a) Primary Purposes1) Identify, locate, or communicate with you, or with whom you designate for such purposes; (2) provide you with the hospitality and hotel services that you generally require and are part of the purpose of the corresponding membership or service provision contract of which you are the contractor or beneficiary; (3) issue the receipts, certificates, and/or invoices required by you; (4) integrate your unique file; (5) attend to any type of procedure related to our services; (6) manage the collection of expenses and/or fees resulting from the provision of our services and from our network of agencies, suppliers, and/or third parties that provide services to you under the hospitality and hotel services contract contracted by you or from which you benefit; (7) provide guidance, advice, customer assistance, to which you have access by reason of the corresponding service provision contract or membership you have with us or with our business partners, associates, affiliates, allies, subsidiaries, and/or affiliates; (8) compliance with tax and hotel services obligations in accordance with the legislation in force.
2. b) Secondary Purposes:(9) administration of the website of “HOTEL BELO ISLA MUJERES”; (10) sending notices about products, services, and promotions of “HOTEL BELO ISLA MUJERES”, its parent company, subsidiaries, business partners, associates, affiliates, allies, subsidiaries, and/or affiliates; (11) for statistical purposes; and (12) conducting quality surveys.

The use of Identification and fiscal data, including financial or patrimonial data, will be directly related to the legal relationship that you or your representative, as the case may be, has with “HOTEL BELO ISLA MUJERES”..

III. TRANSFER OF PERSONAL DATA.

The personal data provided by you may be shared with: (1) Affiliates, partners, associates, and/or subsidiaries of “HOTEL BELO ISLA MUJERES” to provide you with comprehensive guidance, advice, and assistance in hospitality and hotel services in general; (2) the financial institutions that you have indicated and authorized us to collect for the sale and provision of our products and services; (3) the authorities that order the delivery of such information through an order that substantiates and motivates the legal cause of the request; (4) tourism, tax, and administrative authorities, in response to the exercise of their powers in verification, supervision, and surveillance of compliance with applicable laws that, by the nature of the business, are applicable to them; (5) civil associations, civil society, commercial companies, or individuals that have contracted the hospitality and hotel services of which you are a beneficiary; (6) where appropriate, the institution with which you have contracted a membership or of which you are a beneficiary, in order to cover the coverages provided for in the corresponding contract.

The transfers mentioned are necessary for the fulfillment of the purpose of the contract that you have entered into with us or with a third party of which you are the insured or beneficiary, in terms of the provisions of articles 36 and 37, of the Federal Law on Protection of Personal Data Held by Private Parties.

The aforementioned transfers are made under the highest security measures, guaranteeing at all times the confidentiality of your personal information and, in the event of transferring your data to third parties other than those mentioned in this Privacy Notice, we undertake to request your prior consent in the terms and conditions provided by the Law.

The consent of the data subjects will not be necessary when the transfers are made to companies of the corporate and/or business group of “HOTEL BELO ISLA MUJERES” or when such transfer is necessary to provide you with a service or keep administrative files updated.

• The response to your request will be issued within a maximum period of 20 business days, which will be sent to the email address you specify for this purpose, as well as to the address you provide, which will be understood as authorized to hear and receive all kinds of notifications, documents, and values.
• Subsequently, you have an additional 15 business days to exercise the right exercised. When you request specific access to your personal data stored in our files, the means of reproduction of the same will be in physical and/or electronic format, at no cost to you.
• The format for requesting the exercise of any of the mentioned rights will be free, or you can go to the address we have indicated to hear and receive notifications, where we will provide you with a form for you to fill out.
• If you act through a representative or legal representative, he/she must appear in person at the aforementioned address to submit the request in its entirety along with the aforementioned documentation, as well as the original or certified copy of the legal instrument accrediting his/her legal personality, as well as the original and simple copy of his/her valid official identification with photograph and signature (passport or voter ID). In this case, the response to the respective request will be made in person, within the established period, which you can pick up at our address.

1. V. OPTIONS AND MEANS WE OFFER TO LIMIT THE USE AND DISCLOSURE OF YOUR PERSONAL DATA.

You have the right to limit the use and disclosure of your information for purposes other than the object of the contract of which you are the holder or beneficiary. We inform you that the purpose described in section II. of this Privacy Notice is essential for the fulfillment of the contract that gives rise to the legal relationship between “HOTEL BELO ISLA MUJERES” and you, so you have the right to express your refusal for your personal information not to be used for the achievement of the aforementioned uses.

In order to exercise this right, within 5 days following the purchase and/or acquisition of our services, products, and/or goods, you can send us the corresponding request.

The procedure for submitting the request is the same as that applied for the exercise of ARCO rights and consent revocation. The foregoing, without prejudice to being registered in the Public Registry of Users under the responsibility of the National Commission for the Protection of Users of Financial Services (CONDUSEF), in order not to receive advertising from us.

Any modification to this Privacy Notice will be notified through specific mentions and/or publications on our telephone lines and/or website, through visible announcements, brochures, and/or leaflets available in our establishments, customer service centers, or we will notify you via email at the last address you provided us with.

VII. TRACKING TECHNOLOGIES ON OUR WEBSITE.

We inform you that on our website: https://beloislamujeres.com/ we do not use tracking technologies, such as cookies, web beacons, or any other.

By means of this document, I certify that I have received and read in its entirety this Privacy Notice, so I hereby give my consent to “HOTEL BELO ISLA MUJERES” to carry out the processing of my personal information in accordance with the terms and conditions described in it.

Likewise, I expressly consent to the processing of my information (personal data) for the “Secondary Purposes” described in subsection b) of the section “PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA”.
